
E-Scooter Use in Derbyshire – Important Information
Derbyshire Constabulary operates a zero-tolerance approach towards e-scooter use across the county and city. Officers will seize an e-scooter on first interaction, without issuing a warning, and send it for disposal.
In addition to the vehicle being seized, users may face prosecution for a number of offences, including driving without insurance, tax, or a valid licence. In some circumstances, parents may also be held criminally liable for their children’s use of e-scooters.
Since this change came into effect in November 2024, Derbyshire Constabulary has already seized over 450 illegally used e-scooters – and the number continues to rise.
Legal Framework
Under Section 165A of the Road Traffic Act 1988, the police have the power to seize any motor vehicle being used on a public road without the correct documentation. This includes e-scooters, which require a driving licence and insurance to be legally ridden on public land. Use is only legal on private land with the landowner’s permission.
Further enforcement is supported by Section 59 of the Police Reform Act 2002, which allows police to seize vehicles being used in a way that causes or is likely to cause alarm, distress, or annoyance to the public.
A Message to Parents and Carers
It is vital that parents and students are fully aware of the laws around e-scooters. With summer approaching and demand likely to rise, we strongly advise against purchasing e-scooters – even as gifts – as they are likely to be seized if used in public.

The Office of the Police and Crime Commissioner has prepared ready-made resources to help schools spread this message via social media. A 60-second explainer video will also be shared shortly to help young people understand their rights and responsibilities.
We are also working with local authorities to ensure consistent messaging, including the installation of 'No E-Scooter' signs in public parks.
